Welcome to cvlevel ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website at cvlevel.com and our resume builder service (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to update these Terms at any time. We will notify you of material changes via email or prominent notice on our Service. Your continued use after changes constitutes acceptance of the new Terms.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that:

3. Account Registration and Security

3.1 Account Creation

Not create multiple accounts for fraudulent purposes

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your magic link emails
All activities that occur under your account
Notifying us immediately of any unauthorized access

We are not liable for any loss or damage arising from your failure to protect your account.

4. Service Description

cvlevel provides an online resume and cover letter builder with the following features:

Free Tier: Create and edit resumes with live preview, local storage
Pro Tier: PDF download, public sharing links, cloud storage, additional templates

We reserve the right to modify, suspend, or discontinue any feature at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

5. Subscription and Billing

5.1 Pricing

Current pricing plans are available at cvlevel.com/pricing. Prices are subject to change with 30 days' notice.

5.2 Payment Terms

Billing Cycle: Monthly or annual subscriptions (as selected)
Payment Method: Credit card, debit card, or other methods accepted via Stripe
Automatic Renewal: Subscriptions auto-renew unless canceled before the renewal date
Failed Payments: We may suspend your account if payment fails. You remain responsible for unpaid amounts.

5.3 Taxes

You are responsible for any applicable taxes (VAT, sales tax, etc.). Prices displayed may not include taxes.

5.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. No partial refunds for unused time.

6. Refund Policy

Trial Period: If offered, you may cancel during the trial for a full refund
First-Time Users: 14-day money-back guarantee for new subscribers
No Refunds: After 14 days, subscriptions are non-refundable unless required by law

7. User Content and Intellectual Property

7.1 Your Content

You retain all rights to the content you create (resumes, cover letters, etc.). By using the Service, you grant us a limited license to:

Store and process your content to provide the Service
Create backups for data recovery purposes
Display your content to you within the Service

We do not claim ownership of your content. We will not share, sell, or use your resume content for any purpose other than providing the Service.

7.2 Our Intellectual Property

The Service, including its design, code, templates, and all related intellectual property, is owned by cvlevel and protected by copyright, trademark, and other laws. You may not:

Copy, modify, or reverse-engineer the Service
Remove any proprietary notices from the Service
Use our trademarks or branding without written permission
Create derivative works based on the Service

8. Prohibited Uses

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe upon the rights of others (intellectual property, privacy, etc.)
Upload malicious code, viruses, or harmful content
Attempt to gain unauthorized access to our systems
Scrape, spider, or crawl the Service using automated means
Resell or redistribute the Service without authorization
Impersonate any person or entity
Harass, abuse, or harm other users
Use the Service for spam or unsolicited communications
Create fraudulent resumes or misrepresent information

Violation of these prohibitions may result in immediate termination of your account.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose
Non-infringement of third-party rights
Uninterrupted, secure, or error-free operation
Accuracy, reliability, or quality of the Service
Suitability of templates or content for any specific job or industry
Compliance with employer-specific requirements or preferences

⚠️ No Employment Guarantees:

We do not guarantee that using the Service will result in job offers, interviews, or employment. Resume success depends on many factors outside our control, including but not limited to: your qualifications, work experience, job market conditions, employer preferences, and how you present yourself beyond the resume.

You are solely responsible for: The accuracy and truthfulness of all content in your resume; ensuring compliance with applicable laws and regulations; verifying that your resume meets specific employer requirements; and any consequences of submitting your resume to third parties.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, cvlevel SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, goodwill, or other intangible losses
Unauthorized access to or alteration of your content
Third-party conduct or content on the Service
Any interruption or cessation of the Service
Claims by employers or third parties regarding resume content accuracy
Job search outcomes, interview results, or employment decisions

💰 Maximum Liability Cap:

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100 USD, WHICHEVER IS GREATER.

This cap applies regardless of the cause of action, whether in contract, tort (including negligence), strict liability, or otherwise.

Some jurisdictions do not allow certain liability exclusions. In such cases, our liability is limited to the greatest extent permitted by law.

Important Notice: This Service is operated by an individual entrepreneur. The liability limitations above are essential to make this Service economically viable at our current pricing. By using the Service, you acknowledge these limitations are reasonable given the nature and cost of the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless cvlevel, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another person or entity
Content you submit or share through the Service

12. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

We comply with applicable data protection laws, including GDPR (for EU users) and CCPA (for California residents). See our Privacy Policy for details on your rights.

13. Termination

13.1 By You

You may terminate your account at any time by:

Canceling your subscription (if applicable)
Requesting account deletion via support@cvlevel.com

13.2 By Us

We may suspend or terminate your account immediately, without notice, if:

You violate these Terms
You engage in fraudulent or illegal activity
Payment fails or chargebacks occur
We are required to do so by law

13.3 Effect of Termination

Upon termination:

Your access to the Service will cease immediately
We may delete your content after a 30-day grace period
You remain liable for all charges incurred before termination
Provisions that should survive (e.g., indemnification, limitations of liability) will remain in effect

14. Dispute Resolution and Governing Law

14.1 Informal Resolution

Before filing a legal claim, you agree to contact us at support@cvlevel.com and attempt to resolve the dispute informally for at least 30 days.

14.2 Arbitration (US Users)

For users in the United States, any dispute will be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules. You waive your right to a jury trial and class action lawsuits.

14.3 Governing Law and Jurisdiction

Governing Law: These Terms and your use of the Service shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles.

Exclusive Jurisdiction: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Poland. By using the Service, you irrevocably consent to the jurisdiction and venue of such courts and waive any objection to the inconvenience of such forum.

For users outside Poland: Local mandatory consumer protection laws may apply and take precedence over these Terms where applicable. Nothing in these Terms affects your statutory rights as a consumer. However, any legal proceedings must be initiated in Poland.

⚠️ Important: By using this Service, you agree that any legal disputes will be resolved exclusively in Polish courts under Polish law. This protects both parties by providing a clear and predictable legal framework.

15. General Provisions

15.1 Entire Agreement

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and cvlevel.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

15.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

15.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control (natural disasters, pandemics, war, etc.).
